A group
of people punishing someone for some offence without any fair judgment being
passed is what Mob Lynching is all about. Crowd of angry people often
presumes guilt and punishes a person with consequences as severe as “Death” or
“Gang Rape”.
Recently
in Baniyapur-Bihar, India, Three people were beaten to death by mob on
suspicion of cattle theft. This is not the first time when Humanity bowed down,
there are list of several instances where innocents were killed without any
proof of them being committing a crime.
WHAT ARE THE REASONS OF MOB LYNCHING?
1. Different Community Beliefs: Beliefs of one community may differ from beliefs
of other community, where acceptance is difficult and hence disagreement of
other’s views lead to disturbance and violence.
2. Discrimination against Minority: India is well known for its diversity with
respect to religions. Religious
tolerance has deteriorated and violations have increased in past few years in
certain parts of India.
3. Ignorance by Government: Despite of several instances of
mob violence, no severe action has been taken by the government. There has been
delay in enacting any specific law against the same.
ANTI-MOB LYNCHING LAW IN INDIA
Now, the question arises that who all to be blamed in such
scenarios? What does Indian Law says about the assailants?
There is no specific Law against Lynching in India, However,
Criminal Procedure Code, 1973, contains certain provisions which tend to punish
group of people committing similar offence together. Need for Anti Mob Lynching
is arising day by day and Supreme court has already asked the Home Ministry to
enact a Law for rising Mob Lynching cases.
People are expecting now that the Central Government will
come up with the draft legislature in the parliament in current sessions, as
directed by Supreme Court of India.
